  Breeding Contract

 

This certifies ____________________________ herein be referred to as the Mare Owner,  has engaged one breeding to  A MAGICAL MISTER for the  2008 breeding season at $1000.00 for the following mare:

THEREFORE, it is agreed as follows:

1. Upon payment of a $250.00 booking fee, which is non-refundable, Stallion Owner does hereby reserve for the Mare Owner one season’s booking for 2008 to A MAGICAL MISTER for the service of the Mare.

2. The balance of $750.00 , plus all unpaid board and expenses, will be paid when the Mare is picked up or before semen is shipped – whichever is applicable. The breeding fee balance shall be paid in full PRIOR to shipment of cooled semen.  Personal checks for payment of the breeding fee balance must be received by us 10 days prior to shipment. Cashier, certified Checks, or on-line PAYPAL payments will receive immediate credit.

3. The Mare Owner agrees to allow Stallion Owner to have a qualified veterinarian check the Mare for normal breeding conditions and to perform such other veterinary services Stallion Owner deems necessary for the proper treatment and protection of the Mare and/or foal at side.  This is to be at the Mare Owner’s expense and will be billed and due as necessary.

4. During the time the Mare is in the custody of Stallion Owner, Stallion Owner shall not be liable for any sickness, disease or injury which may be suffered by  the mare and/or foal at side.

5. None of the above-mentioned fees shall be refundable.  But, Stallion Owner guarantees a return breeding the following season, either for said Mare or her substitute which is acceptable to Stallion Owner, should a live foal (defined as one that stands and nurses without assistance) not result from this mating.  This is to be evidenced by a written statement from a qualified veterinarian.

6. This Agreement shall not be assigned or transferred by either party hereto without the consent of the other.  Any dispute arising out of this Agreement shall be substituted to binding arbitration in accordance with California rules and procedures. Such arbitration shall be conducted in Riverside  County, California.

7. It is further agreed that should the above stallion die or become unfit for breeding or shall the above mare die or become unfit for breeding, this contract shall be null & void.

8. ADDITIONAL FEES:  Collection/Shipping/Container Fee…………$250.00 . All requests for Cooled Shipped Semen, must be paid for in advance of shipment.  PayPal payment will be excepted for payment.  All fees are payable to Doreen Beale. CONTAINERS must be returned to Stallion Owner at Mare Owners expense.

9. REQUIRED BREEDING DOCUMENTATION: The following documentation shall be delivered to the breeder at the time this Contract is executed: A copy of the Mares Registration Papers.

10. A chute fee of $350.00 will be charged on all rebreeds.(this fee includes first shipped shipment).

11. A Breeders Certificates will be issued to the Mare Owner only after Mare Owner has notified Breeder that said mare has produced a live foal and only after payment of any and all bills due on said mare has been received.
